The harsh reality: marriage requirements in Kuwait

According to Kuwaiti law, the marriage process for Muslims and non-Muslims differs significantly. Muslim couples are married in the Sharia court. The ceremony requires the presence of the bride’s father or guardian and two male Muslim witnesses. If the bride is Muslim, she is strictly forbidden from marrying a non-Muslim; her partner must convert to Islam. Non-Muslim couples (Christians) first get married in a church, and then legalize the marriage at the authorized government bodies (Family Court).

Foreign citizens must prepare documents for marriage in Kuwait in advance. All papers must be legalized: translated into Arabic or English, notarized, and attested by the Ministry of Foreign Affairs of both the home country and Kuwait. Registration requires originals and copies of the couple’s passports, birth certificates (in some cases), and divorce or death certificates of a previous spouse. Expats must provide a Certificate of No Impediment (CNI), issued by their country’s embassy.

A Strict Mandatory Requirement: All couples must undergo a medical examination for marriage. Future spouses submit blood tests for infectious diseases and genetic compatibility. Why are Kuwait's laws "tough"?

As in many Muslim countries, there is no institution of “civil marriage” in the secular sense familiar to us. Marriage in Kuwait for foreigners of different nationalities involves certain difficulties. Couples are required to obtain certificates proving the absence of officially valid marital relationships with other partners. If the couple is located within Kuwait, obtaining such papers can be quite difficult. In some cases, they have to travel to their home country to process them.

Another difficulty lies in guardianship. If the bride’s father or guardian (Wali) lives in another country or does not give consent to the marriage, she cannot get married. For expats, the legalization of a marriage certificate in Kuwait is quite a lengthy procedure. The state has not signed or ratified the Hague Apostille Convention. The document must be legalized by the Ministry of Justice and the Ministry of Foreign Affairs.
